Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Active Electrical website (https://active-electrical.hypex.au) and any purchase you make through it. By using the site or placing an order, you agree to these Terms.

The website is operated by Active Electrical Distributors Pty Ltd (ABN 29 005 246 799) ("we", "us", "our"). If you do not agree to these Terms, please do not use the site.

Some products and pricing are available only to approved trade-account customers. You are responsible for keeping your account login details secure and for all activity that occurs under your account.

You must provide accurate, current and complete information when creating an account or placing an order, and keep that information up to date.

We make every effort to ensure product descriptions, images and prices are accurate. Errors may occasionally occur; where a pricing or description error is identified, we reserve the right to correct it and to cancel any affected order, even after it has been submitted.

Unless stated otherwise, all prices are shown in Australian Dollars (AUD). Prices may be displayed inclusive or exclusive of GST depending on your account and the page you are viewing; the amount payable at checkout is the amount that applies to your order.

Product availability is not guaranteed and stock levels can change. We may limit or decline order quantities at our discretion.

Your order is an offer to purchase. A contract is formed only when we accept your order, which may be by confirmation email or by dispatching the goods. We may decline or cancel an order before dispatch — for example, due to stock, pricing errors, payment issues or suspected fraud.

Where we cancel an order you have already paid for, we will refund the amount paid for the cancelled items.

Payment may be made by the methods offered at checkout, which may include credit/debit card, trade-account credit, or invoice for approved accounts.

Card payments are processed securely by our payment provider (NAB). We do not store your full card details on our systems.

Where you pay on a trade-account or by invoice, payment terms agreed with your account apply, and we may suspend or withdraw credit facilities in accordance with those arrangements.

Delivery is governed by our Delivery Policy, and returns and refunds by our Returns & Refund Policy, each of which forms part of these Terms.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits any rights you have under that law.

To the maximum extent permitted by law, and subject to the consumer guarantees referred to above, our liability for any claim relating to a product or your use of the site is limited to re-supplying the product or refunding the price paid.

We are not liable for any indirect or consequential loss, and we do not warrant that the website will be uninterrupted or error-free.

All content on this website — including text, graphics, logos and images — is owned by or licensed to Active Electrical Distributors Pty Ltd and is protected by law. You may not reproduce or use it without our permission.

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
